Welcome to the YOURSIZER website and services ("Service"). These Terms of Service ("Terms") constitute a legal agreement between YOURSIZER ("we", "us", or "Company") and you ("user" or "you"). 4. Intellectual Property Rights

4.1. Ownership of YOURSIZER Platform Content

All content, software, design, text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and the compilation of software on the YOURSIZER website and Service ("YOURSIZER Content") are the property of YOURSIZER or its content suppliers and are protected by intellectual property laws. Unauthorized reproduction, modification, distribution, sale, or other use of YOURSIZER Content is strictly prohibited.

4.2. Ownership and Licensing of User-Generated 3D Avatars

User Ownership:
You retain ownership of your personal body measurements and the underlying data of your 3D avatars created based on these measurements.

License to YOURSIZER:
For the purpose of providing our Service to you and improving our Service, you grant YOURSIZER a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, display, and distribute your 3D avatars and related measurements (in anonymized or pseudonymized form). This license applies specifically to generating size recommendations, improving our algorithms, analyzing Service performance, and for aggregated research purposes.

Commercial Use by User:
Your right to use the 3D avatars you create for commercial purposes outside of YOURSIZER is subject to YOURSIZER's express written permission. Unless otherwise specified, you agree that avatars created through the Service are for non-commercial, personal use.

Protection Against Third-Party IP Infringement:
You warrant that any content you upload or create through the Service (including 3D avatars) does not infringe upon the intellectual property rights (copyright, trademark, etc.) or other rights of third parties. YOURSIZER reserves the right to remove infringing content and accepts no responsibility for any such infringements. You agree to indemnify YOURSIZER against all claims arising from such infringement.

5. Disclaimers

Our Service is designed to facilitate your online shopping experience. However, there are certain limitations and disclaimers:

5.1. Size Recommendation Disclaimer

The size recommendations provided by YOURSIZER are estimates based on the measurements you enter and the brand size data provided, and do not guarantee a perfect fit. Actual fit may vary due to individual body shape nuances, garment cut, fabric, brand-specific variations, and your personal preferences.

• YOURSIZER makes no warranties regarding the accuracy, completeness, or timeliness of the size recommendations provided.
• The final purchase decision and product selection are solely the user's responsibility. YOURSIZER recommendations are merely a guide and should not be interpreted as binding advice.
• Users are advised to review brand-specific size charts and consider their personal preferences before making a purchase.

5.2. General Service Disclaimer

The Service is provided on an "as is" and "as available" basis. YOURSIZER does not warrant that the Service will be uninterrupted, error-free, or secure. YOURSIZER accepts no responsibility for:

• Service interruptions, delays, errors, or malfunctions in the operation of the Service.
• The accuracy, completeness, or timeliness of content provided by third parties (e.g., brand size charts) or links to external websites.
• Damages resulting from viruses, malware, or other security risks on users' own devices, despite YOURSIZER's security measures.
• Service interruptions or data losses caused by force majeure events (natural disasters, war, acts of terrorism, cyberattacks, etc.).

6. Limitation of Liability

To the fullest extent permitted by applicable law, YOURSIZER shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including, but not limited to, loss of profits, loss of data, or business interruption) arising from your use or inability to use the Service. YOURSIZER's total liability to you shall in no event exceed the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless YOURSIZER, its directors, employees, and agents from and against any and all claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Service.
